Responding to the Centers plea, in a sharp comment, the Supreme Court bench of Justice Arijit Pasayat and Justice L S Panta said: You (are supposed to) frame the rule and then play the game. But here you are playing the game first and then framing the rule!
The Bench however said it would examine the Centres plea for referring the issue to a Constitution Bench.
The Bench gave the order after the Solicitor General G E Vahanvati made a vehement plea for vacating the stay while arguing that the Apex Court had no power to pass any final order on the subject. The Solicitor Generals argument was that any final order on the matter can be passed only by a Constitution Bench and not by a two-judge Bench of the Apex Court.
The matter is expected to now come up for final hearing in August.
